1. Acceptance of these Terms
By creating an account or using Drive Sure ("the App"), you agree to these Terms of Use. If you do not agree, do not install or use the App. Your continued use after we update these Terms means you accept the updated version.
2. Educational tool, not advice
Drive Sure provides educational and informational content to help consumers understand vehicle pricing, financing, and dealer interactions. The App does not provide legal, tax, accounting, financial, lending, brokerage, appraisal, or warranty advice. Always confirm any number with the relevant professional before acting on it.
3. Estimates and third-party data
Vehicle values, retail price ranges, comparable listings, days-on-market, dealer information, and similar data points come from third-party providers (currently MarketCheck and the U.S. National Highway Traffic Safety Administration’s vPIC service) and may be incomplete, delayed, or inaccurate. Estimates depend on the data available and assumptions made by those providers and our app. Real prices, fees, and financing terms are determined by the dealer, the lender, and your credit profile, and will vary.
4. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. The App is intended for personal, non-commercial use by consumers in the United States. Use outside the U.S. may produce inaccurate or unavailable results.
5. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at the support address if you believe your account has been compromised. We may suspend or terminate accounts that we believe are being used to violate these Terms or to harm the App or other users.
6. Acceptable use
You agree not to: (a) reverse-engineer, scrape, or attempt to extract source code or proprietary data from the App or its servers; (b) use the App or any third-party data accessed through it for resale, redistribution, or in any commercial product without permission; (c) submit false or misleading information; (d) interfere with the App’s operation, security, or other users; or (e) use the App in violation of any applicable law.
7. Saved data
When you save VIN reports, deal calculations, notes, or similar items, that content is stored under your account. You may delete saved items inside the App. Deleting your account or specific items removes them from your active view; backups and operational logs may persist for a limited time per our standard retention practices.
8. Intellectual property
The App, its design, code, copy, and arrangement are owned by the publisher of Drive Sure and protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. Marketplace and vehicle data displayed through the App is owned by the respective providers and is subject to their terms.
9. Disclaimers
THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY VEHICLE VALUE, COMPARABLE LISTING, FEE, RATE, OR PAYMENT FIGURE IS ACCURATE, CURRENT, OR COMPLETE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER OF DRIVE SURE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY U.S. DOLLARS ($50). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in those places, our liability is limited to the maximum extent permitted by law.
11. No relationship with dealers, lenders, or sellers
We are not a dealer, broker, lender, or appraiser, and we are not an agent for any dealer, lender, or seller. We do not negotiate on your behalf. The App may surface third-party listings or contact information; any transaction you pursue is between you and that third party.
12. Changes to the App and these Terms
We may update or discontinue features at any time. We may also update these Terms; the "last updated" date below reflects the current version. Material changes will be highlighted in-app where reasonable. Your continued use after updates take effect means you accept them.
13. Governing law and disputes
These Terms are governed by the laws of the state in which the publisher is organized, without regard to conflict-of-law rules. Any dispute arising from the App will be brought in the state or federal courts of that jurisdiction, and you consent to that jurisdiction. (Specify jurisdiction with counsel before launch.)
